Agreement for Assumption of Risk, Indemnification, and Release, for Band Participants

Event: Miami Broward Carnival (the “Event”)

Band: RIVERLAND MAS POWERED BY FANTASTIC 5 ENTERTAINMENT (the “Band”)

In consideration of being permitted to participate in any and all activities related to the Miami Broward One Carnival organized or sponsored by the Band (including, without limitation, King and Queen Presentation, Kids Carnival, the Parade of Bands, J’ouvert, rehearsals, and any related social or promotional events), and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I, the undersigned participant (or parent/guardian if applicable), hereby knowingly, freely, voluntarily, and without duress agree as follows:

1. EXPRESS ASSUMPTION OF RISK

I fully understand and acknowledge that participation in the Event involves inherent, obvious, and latent risks of serious injury, permanent disability, paralysis, and death. These risks cannot be eliminated even with reasonable care by the Band. Such risks include, but are not limited to:

• Slips, trips, falls, or collisions on streets, sidewalks, or uneven surfaces;

• Water, puddles, or wet conditions on the streets;

• Injuries caused by costumes, props, feathers, wire, footwear, or other equipment;

• Crowd-related hazards including surges, compression, pushing, or contact with other participants; • Exposure to high-volume music that may cause temporary or permanent hearing damage;

• Heat exhaustion, dehydration, sun exposure, or adverse weather conditions;

• Contact with paint, powder, oil, or other substances used during J’ouvert;

• Risks associated with the presence or consumption of alcohol by participants or third parties;

• The negligent or intentional acts of other participants, spectators, or third parties.

I understand that injuries may range from minor (scratches, bruises, sprains) to major (fractures, joint/back injuries, concussions, loss of vision or hearing, heart attack) to catastrophic (permanent disability or death). I voluntarily choose to participate with full knowledge of these risks. I expressly and voluntarily assume all risks of injury, death, or property damage arising out of or related to my participation, whether such risks are known or unknown, foreseen or unforeseen, and whether caused in whole or in part by the ordinary negligence of the Band or any Released Party.

2. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Band and its officers, directors, members, managers, employees, agents, volunteers, independent contractors, affiliates, subsidiaries, sponsors, insurers, successors, and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, causes of action, damages (including compensatory, consequential, incidental, or punitive), costs, and expenses (including reasonable attorneys’ fees) of any kind whatsoever, arising out of or related to any loss, damage, injury (including death), or property damage that I may sustain while participating in, traveling to or from, or otherwise in connection with the Event, whether caused by the ordinary negligence of the Released Parties or otherwise. This release is intended to be as broad and inclusive as permitted by the laws of the State of Florida. I understand that this release means I am giving up my right to sue the Released Parties for injuries or damages resulting from ordinary negligence.

3. INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) my participation in the Event; (b) my breach of this Agreement; or (c) any injury or damage I cause to any person or property. This indemnification obligation includes claims based on the ordinary negligence of the Released Parties, but expressly excludes claims based solely on the intentional misconduct of the Released Parties.

4. RULES OF CONDUCT AND AUTHORITY TO REMOVE

I agree to follow all instructions, safety rules, and directions given by the Band or its representatives. I understand that failure to do so may result in injury to myself or others and may result in immediate removal from the Event without refund. The Band reserves the absolute right to refuse or revoke my participation at any time for any reason.

5. MEDICAL FITNESS AND AUTHORIZATION

I represent that I am in good physical and mental health and have no condition that would make my participation unsafe. I authorize the Band and its representatives to secure emergency medical treatment for me if they reasonably believe it is necessary. I agree that I am solely responsible for all medical expenses and that the Band has no obligation to provide medical care beyond reasonable emergency assistance.

6. LIKENESS AND PUBLICITY RELEASE

I grant the Band and its licensees the irrevocable right to use my name, likeness, image, voice, and biographical information, without compensation, in any media now known or hereafter devised, for promotional, advertising, or commercial purposes related to the Band or the Event.

7. GENERAL PROVISIONS

Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Governing Law & Venue. This Agreement shall be governed by the laws of the State of Florida. Any legal action arising out of this Agreement or my participation shall be brought exclusively in the state courts located in Broward County or Miami-Dade County, Florida.

Entire Agreement. This document constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, and understandings. No modification shall be valid unless in writing and signed by both parties.

Voluntary Execution. I acknowledge that I have had a full and fair opportunity to read this Agreement, ask questions, and consult with an attorney of my choice before signing. I am signing voluntarily and without any pressure or coercion.

This is a legally binding contract. By signing, you acknowledge that you have read, understood, and agreed to all terms. If you do not understand any part of this document, do not sign it until you have consulted an attorney.

PARENT / LEGAL GUARDIAN SECTION (Required if Participant is under 18)

I am the parent or legal guardian of the minor Participant named above. I have read this entire Agreement and understand its terms. On behalf of the minor and myself, I agree to all terms of this Agreement to the maximum extent permitted by Florida law, including Fla. Stat. § 744.301(3). I understand that under Florida law a parent may waive only claims arising from the inherent risks of a commercial recreational activity for a minor, and not the provider’s own negligence. I further agree to indemnify and hold harmless the Released Parties from any claims arising out of the minor’s participation. I consent to the minor’s participation and to emergency medical treatment if needed.
